Annual Home Care Worker Wage Parity Compliance Requirements Beginning June 2022

Beginning June 1, 2022 and annually thereafter, New York State law requires the following entities to complete and submit an annual certification of compliance with the Home Care Worker Wage Parity Law—Public Health Law § 3614-c—to the New York State Department of Health via the Provider Portal at emedny.org:

  • Certified Home Health Agencies (CHHAs)
  • Long Term Home Health Care Programs (LTHHCPs)
  • Licensed Home Care Services Agencies (LHCSAs)
  • Consumer Directed Personal Assistance Program Fiscal Intermediaries (FIs)

This requirement applies to our network providers who deliver home care services to EmblemHealth Medicaid, HARP, and/or CHPlus members in New York City, Nassau, Suffolk, and/or Westchester counties.

Additionally, all LHCSAs and FIs must complete and submit both of the following Department of Labor (DOL) forms to EmblemHealth via email at wageparity@emblemhealth.com by April 15, 2022:

  • An Annual Compliance Statement of Wage Parity, Hours and Expenses (LS300)
  • An Independently Audited Financial Statement Verifying Employer’s Wage Parity Hours and Expenses (LS301)

LHCSAs and FIs must also complete and submit both forms to each CHHA and LTHHCP with which they contract. To access these forms and additional information, visit the DOL website.
