Annual Home Care Worker Wage Parity Compliance Requirements Update

The New York State Department of Health extended the due date for the submission of the Department of Labor’s “Annual Compliance Statement of Wage Parity, Hours, and Expenses” form (LS300) for calendar year 2025.

The new submission deadline is June 15, 2026 for all the following service types:

  • Contracted licensed Certified Home Health Agencies (CHHAs).
  • Contracted Licensed Home Care Services Agencies (LHCSAs) and Consumer Directed Personal Assistance Program Fiscal Intermediaries (FIs).

Form LS300 must be submitted via email to EmblemHealth at wageparity@emblemhealth.com.

Note: If you are contracted for more than one of these service types, please submit separate documents for each.

These requirements apply to LHCSAs, FIs, and CHHAs who deliver home care services to EmblemHealth Medicaid, HARP, or CHPlus members in New York City, Nassau, Suffolk, or Westchester counties. EmblemHealth must certify receipt of these documents from all contracted LHCSAs, CHHAs, and FIs to the New York State Department of Health by June 30, 2026.

Starting for submissions in 2027 for calendar year 2026, the compliance due dates for CHHAs, LHCSAs, and FIs will be as follows:

  • Form LS300 is due to EmblemHealth by June 1 of each year for the previous calendar year.
  • Department of Labor Form LS301 and Audited Financial Statements or Agreed Upon Procedures are due to EmblemHealth by October 1 each year for the previous calendar year.
  • Annual Certification of Compliance with Home Care Worker Wage Parity is due to the Department of Health by December 1 of each year for the current calendar year through eMedNY Provider Portal.

EmblemHealth must certify receipt of these documents from all contracted LHCSAs, CHHAs, and FIs to the New York State Department of Health by December 1 of each year for the current calendar year through eMedNY Provider Portal.
